Who is the Harris County,Texas DWI "No Refusal" Weekends Really Helping?

I previously mentioned that the Harris County District Attorney's Office received a grant that will allow them to have "DWI No Refusal" weekends all the time. Currently they are typically conducted over holiday weekends. While everyone is celebrating how this is going to reduce the number of drunk drivers on the streets of Houston I am not joining in their celebration. The fact remains that DWI figures have not been shown to support that more arrests are made when these weekends are in place. More importantly, the general public is not aware what this really means to them. Many of my clients are shocked to learn after their DWI arrest that the government can legally draw blood from them after refusing a breath test. Many people find this "un-American" and unconstitutional despite the law being clear. Politically, it makes it seem like the Government is strong on DWI offenders, but the truth is that people feel like their civil liberties are being trampled upon. I foresee that the public is going to get wise to this and stop answering any questions when it comes to drinking and driving. Nevertheless, I still envision the DWI Task force officer using the smell of alcohol, red blood shot eyes, and slurred speech as being the reason that they arrested most of their arrestees, despite having any evidence of intoxication.
