Human Breathalyzer Sentenced to Jail

It seems like every year someone wearing the Breathalyzer costume for Halloween is arrested for drunk driving.  I wonder if that person realizes that if they are stopped by a police officer while wearing the costume it is very likely they will be arrested for DWI if they have had anything to drink that night.  Perhaps, some people like  Matthew Nieveen think it is ironic to wear the costume if they had previously been convicted of drunk driving.  Nevertheless, I bet Mr. Nieveen is regretting his decision now that he has been branded a repeat offender and sentenced to 90 days in jail for his actions.  The judge is his case did not his appreciate Mr. Nieveen's humor.  By wearing the costume he was telling the judge that he did not learn anything from his previous DWI and did not respect the judicial system.  While I understand the judge's decision in this case I still disagree with the sentence.  Mr. Nieveen is a 19 year child that has serious issues with alcohol that need to be addressed before he not only injures himself but others too.  A jail sentence does not help him deal with future alcohol abuse.  Luckily, Harris County, Texas has a DWI Court that caters to repeat or second offenders in order to properly treat their issues.  It is a type of probation that requires a lot of counseling, education, and rehabilitation for those that have alcohol problems.  According to one of my clients this program has changed his life.
