Be Careful Drinking Alcohol After Weight Loss Surgery
One of the saddest things about the DWI/DUI law in Texas is that it does not take into account a person's state of mind. In other words, it does not matter if the person did not intend to drive under the influence. This happens frequently when someone takes a new medication and decides to drive for example. Most prosecutors understand that this can happen to anyone, but they still attempt to convict the person. Jurors in Harris County, Texas are more understanding of this happening so long as the prescription does not clearly advise that they should not drive while taking the medication. On the other hand, prosecutors and juries do not feel sorry for a person that drinks alcohol while on any type of medication. Luckily, the state must have more proof other then a person's statement to introduce the fact that they are on medication.
Now, those that have elected to have the Gastric bypass surgery for weight loss must be aware that they are more likely to get intoxicated much easier than they would have before the surgery. Amazingly, ONE glass of wine made a person legally intoxicated (over a .08) after they had this surgery. Just another way a seemingly innocent person can be convicted of DWI.
